Apple failed to convince a US judge to block Samsung Electronics from selling Galaxy smartphones and tablets in the US market, depriving the iPhone and iPad maker of crucial leverage in a global patent battle between the two companies.
In a ruling released late on Friday, US District Judge Lucy Koh in San Jose, California denied Apple’s request for a preliminary injunction against Samsung.
The two companies are engaged in a bruising legal battle that includes more than 20 cases in 10 countries as the they jostle for the top spot in the smartphone and tablet markets.
Earlier on Friday, an Australian court extended a halt on sales of Samsung’s latest Galaxy tablet in the country by at least a week, as Apple appeals a ruling that had ended the ban.

But on Friday Koh rejected Apple’s bid to ban sales of three smartphone models, as well as the Samsung Tab 10.1.
“It is not clear that an injunction on Samsung’s accused devices would prevent Apple from being irreparably harmed,” Koh wrote.
Apple spokeswoman Kristin Huguet on Friday referred to previous Apple statements about the case, saying that Samsung’s “blatant copying is wrong.”
Samsung spokesman Jason Kim said Samsung welcomed Koh’s opinion. “This ruling confirms our long-held view that Apple’s arguments lack merit,” Kim said in an email.
Apple could still prevail in the overall lawsuit. But it’s inability to win a quick halt to Galaxy sales in the United States comes as the stakes skyrocket in one of the fastest growing consumer electronics markets.
UNDER PRESSURE
Global tablet sales are expected to explode to more than 50 million in 2011. Apple, which has sold more than 30 million iPads so far, is expected to continue to dominate the market in the near term.
Apple’s new CEO Tim Cook is under pressure to show he can fill the large shoes of his predecessor, late Silicon Valley titan Steve Jobs. But in his first quarterly result unveiled as permanent CEO, Apple stunned Wall Street, missing expectations for the first time in years.
Analysts said customers held off buying iPhones in the September quarter, waiting for the October launch of the latest iPhone 4S.
But tablets proved a bright spot. The company moved 11.12 million units during the quarter despite attempts by various manufacturers, including Samsung, to capture a slice of the tablet market.
Now Amazon.com has also entered the fray with its Kindle Fire tablet, but Samsung’s Galaxy line-up is widely deemed the closest rival in terms of capability and design to the iPad.
Acknowledging the competition, Cook said it was “reasonable to say” none of Apple’s rivals have gained any traction, and he expected the tablet market to be bigger than personal computer in the long term.
In her ruling, Koh wrote that for some of the smartphones, “Apple has established a likelihood of success on the merits at trial.”
Koh added that Apple would likely prove Samsung infringed one of its tablet patents. However, Apple had not shown that it was likely to overcome Samsung’s challenges to the patent’s validity, Koh wrote.
Apple must demonstrate both infringement and validity to succeed in its lawsuit.

With the iPhone 5 release date expected to take place next month, new reports have suggested Apple is to hold an official unveiling event for the much mooted handset on October 4th with new Apple CEO Tim Cook to take the reigns for the first time.
The latest in a long line of iPhone 5 rumours, the new reports from The Wall Street Journal’s tech blog AllThingsD cites “sources close to the situation” in stating Apple will finally make the long awaited iPhone 5 official in just under two weeks time.
Whilst it is unknown what other devices will touch down alongside the iPhone 5 at Apple’s autumn event, an entry level iPhone 4S, revamped white iPod Touch 3G and updated Apple HDTV have all been tipped as possible arrivals.

Numerous reports in recent weeks have claimed Apple is working to an October 21st iPhone 5 release date with leaked iPhone 5 pictures suggesting the handset will land boasting the same A5 dual-core processor as the iPad 2. Further iPhone 5 specs tipped for inclusion will see an 8-megapixel rear-mounted camera with 1080p Full HD video recording capabilities land alongside a new, slimmer form factor.

In an ongoing battle against trademark infringement, Apple has filed a lawsuit against two sellers of knockoff Apple accessories based in the New York City neighborhood of Flushing, Queens, according to documents unsealed Thursday in Brooklyn federal court.
The defendants — Apple Story and Fun Zone, both owned by New York resident Janie Po Chiang — are accused of selling unauthorized iPod, iPhone and iPad accessories branded with the company’s iconic logo and signature markings and phrases found on genuine Apple products, including “Designed by Apple in California. Assembled in China.”
Apple is also asking that Apple Story be ordered to change its name to minimize confusion of brands among consumers.
Apple reported having sent representatives to the two counterfeit hawkers in question, where they bought an assortment of unauthorized accessories, including stereo headsets designed for use with the iPhone that came in packaging that was “nearly an exact duplicate” to the original packaging.
The case was filed on July 25, but was not made public until Thursday, due to a U.S. trademark counterfeiting law that enables a company to initially file a trademark infringement complaint under seal, so as not to tip off accused perpetrators before goods have been seized.
At Apple’s request for a preliminary injunction, U.S. District Judge Kiyo Matsumoto has ordered both stores to stop selling counterfeit goods. He has not yet issued an order on whether Apple Story must change its name.
Above all of its other requests, the most important for Apple’s mission to stamp out knockoffs may be its request to receive a complete lists of individuals and businesses who have purchased or sold counterfeit goods. The company has been granted access to the defendants’ business email accounts, where evidence of such business deals may be found.
This case comes at a pivotal time for Apple, having recently passed Exxon to become the most valuable company in the world and having also passed Lenovo in greater China sales.
As if counterfeit goods weren’t enough to handle, Apple has also been battling for the shutdown of fake Apple stores in China, one of its most promising markets.
It looks almost exactly like a sleek Apple Store. Sales assistants in blue T-shirts with the company’s logo chat with customers. Signs advertising the iPad 2 hang on the white walls. Outside, the famous logo sits next to the words “Apple Store” — one of the few clues that the whole thing is a fake.
China, long known for producing counterfeit consumer gadgets, software and brand-name clothing, has reached a new piracy milestone — fake Apple stores.
An American who lives in Kunming in southern Yunnan province said Thursday she and her husband stumbled on three shops masquerading as bona fide Apple stores in the city a few days ago. She took photos and posted them on her BirdAbroad blog.
The 27-year-old blogger, who spoke on condition of anonymity, said the setup of the stores was so convincing, the employees themselves seemed to believe they worked for Apple.
“It had the classic Apple Store winding staircase and weird upstairs sitting area. The employees were even wearing those blue T-shirts with the chunky Apple name tags around their necks,” she wrote on her blog.
“But some things were just not right: The stairs were poorly made. The walls hadn’t been painted properly. Apple never writes ‘Apple Store’ on its signs — it just puts up the glowing, iconic fruit.”
A worker at the fake Apple Store on Zhengyi Road in Kunming, which most of the photos of the BirdAbroad blog show, told The Associated Press that they are an “Apple Store” before hanging up.
But the three stores are not among the authorized resellers listed on Apple Inc.’s website. The maker of the iPhone and other hit gadgets has four company stores in China — two in Beijing and two in Shanghai — and various official resellers.
Amy Bessette, a spokeswoman for the Cupertino, Calif.-based company, said it had no comment on the Chinese stores, but pointed to a web page on Apple’s Chinese site that lists its authorized resellers.
The manager of an authorized reseller in Kunming, who gave only his surname, Zhang, said most customers have no idea the stores are fake.
Some of the staff in the stores “can’t even operate computers properly or tell you all the functions of the mobile phone,” he said.
“There are more and more of these fake stores in Kunming. Although they may sell real Apple products, some of those products were not imported through legal means.”
The proliferation of the fake stores underlines the slow progress China’s government is making in countering a culture of rampant piracy and widespread production of bogus goods that is a major irritant in relations with trading partners.
China’s commerce minister promised American executives earlier this year the latest of several crackdowns on product piracy would deliver lasting results.
Piracy is especially sensitive at a time when Washington and other Western governments are trying to create jobs by boosting exports.
UPDATE 2: Digitimes reports that the new iPhone 5 will have a Duel LED flash
UPDATE 1: Its been reported that the iPhone 5 will be more powerful than the iPhone 4 and will feature the A5 processor that was added to the iPad 2 earlier in the year. There will also be an update for the camera which will now be 8 megapixel rather than the iPhone 4′s 5 megapixel.
Bloomberg have also reported that the new device will run on Apple’s latest iOS 5 that was previewed at a developers conference a couple of weeks ago.
It’s that time of the year again when the next round of Apple rumours begin, and although we’re hearing that yet another iPad could be surfacing later on in the year, it’s the iPhone 5 that’s got us buzzing.
The main rumour on the table is that it could be unveiled sometime around August/September later on in the year, and with an Apple conference in September that seems the more likely option.
However, BGR.com seems to think that Apple will break its unveiling tradition, with a ‘source’ telling them that ‘Apple may hold an event in the beginning or middle of August to announce the new iPhone, with availability to follow in the last week of August’.
It’s also rumoured that the spec of the iPhone 5 will be radically different to that of the 4, despite the fact Apple are already working on the iPhone 4S (which apparently is nothing to do with the 5). Another ‘source’ also tells Engadget writer Joshua Topolsky that “the new model (or at least one of the new designs in testing) looks “more like the iPod touch than the iPhone 4” and could even feature more of a teardrop design, as Topolsky mocks up in his blog (image to the left).
Although most rumours suggest the 5 will have a 4 inch screen, Topolsky suggests the screen will only be 3.7-inches (keeping the current resolution) and that the pixel density will drop from 326 to 312ppi. He says this still leaves the possibility of Retina Display technology.
